Pierce Brosnan Paparazzo Pushes Back (E! Online)

Los Angeles (E! Online) - The paparazzo who allegedly brought out the less suave side of Pierce Brosnan is still aiming to have his day in court.

The supposedly slighted photog sued the erstwhile James Bond Monday for assault, battery and negligence stemming from their Oct. 26 run-in in the parking lot of a Malibu shopping center.

Freelance shutterbug Robert Rosen has told police that he approached Brosnan and his young son outside the Mexican eatery Casa Escobar and complimented the British thesp on his 007-embodying skills.

After which, Rosen says, the actor cursed him out and sucker-punched him in the chest.

Los Angeles prosecutors concluded last month that there wasnt enough evidence to press charges against Brosnan for what Rosen claims was a totally unprovoked attack, but the alleged victim--who eyewitnesses said retaliated with a swift kick to Brosnans midsection before fleeing the scene--has figured out that there are other ways to make the Die Another Day star pay.

According to the complaint filed in L.A. Superior Court, Brosnan suddenly and without warning attacked Rosen, causing severe physical and emotional pain and injuries, including bruised ribs.

Rosen was not chasing, following or harassing the actor, nor was he invading his privacy, the lawsuit states. Meanwhile, Brosnan fashioned his excessive, awful, malicious attack to inflict pain and injury, Rosen claims.

The lensman is seeking unspecified general and punitive damages, as well as lost earnings and the cost of medical and psychological treatment.

Brosnans camp has not yet responded to the allegations, but his reps declined to comment on the issue back when it was a possible criminal matter.
