Baldwin Bro Wants Warrant Nixed (E! Online)

Los Angeles (E! Online) - Blame it on a scheduling mishap.

Thats the excuse Daniel Baldwins attorney, Grant Hoagland, plans to offer in asking the court to drop a no-bail bench warrant for the troubled thesp after he failed to show up for a hearing and give an update on the progress hes been making in his drug recovery.

It was a lack of miscommunication, the legal eagle told E! Online. He got hung up shooting an HBO movie in Toronto.. He couldnt get back and he and his manager called and left a message [with the probation officer].

According to Hoagland, the 47-year-old Baldwin was aware of the proceeding but relied on his probation officer Thursday to inform the judge that he wouldnt be able to attend because he was north of the border on a court-approved travel permit filming the movie, Grey Gardens.

Unfortunately for him, Los Angeles Superior Court Judge Scott Millington never got wind of the cancellation and subsequently put out an APB for the Homicide: Life on the Street detective, whos obliged to attend all court hearings after he and another man were collared in April 2006 for smoking cocaine at a Santa Monica motel. Along with the warrant, the judge also revoked Baldwins bail.

Baldwin avoided jail time for misdemeanor cocaine possession and being under the influence by agreeing to enter a drug-diversion program and promising to get clean.

To that end, at a previous hearing in February, Hoagland told the judge that the actor--who has struggled for years with drug and alcohol abuse and has become Larry Kings go-to guy on the issue--had passed 20 court-ordered drug tests after finishing a stint in rehab and was doing exceptional.

He had also enrolled in an aftercare program that required him to undergo intensive counseling, have a sponsor and complete a 12-step course to sobriety.

After this latest incident, Baldwins probation officer gave the judge a report on Friday that indicated the second-oldest Baldwin bro had skipped an appointment two days prior and was MIA from several Alcoholics Anonymous meetings.

His lawyer, however, said that he hoped to clear up the matter by bringing his client before Millington on Wednesday morning when Baldwin returns from shooting the flick. He then intends to ask the judge to dismiss the warrant and reinstate Baldwins probation.

This isnt the first time the Car 54: Where Are You? stars whereabouts have landed him in hot water.

Earlier this year, Baldwin missed his arraignment in connection with another 2006 bust in Orange County, this one for allegedly stealing a friends SUV, and a warrant was issued for his arrest. He subsequently explained his absence by saying he had been in Detroit working on the indie film Little Red Devil. Eventually, prosecutors dropped the theft charges after his pal chalked up the incident to a misunderstanding.

Seems like Baldwins having a lot of those these days.
