Los Angeles (E! Online) - Theyre going to lock Gary Collins up, but they wont be throwing away the key.
The Airport actor, who was sentenced last week to four days in jail stemming from his October DUI bust, will not face additional charges as a result of the death of the man who police say caused the car crash that led to Collins arrest.
Since the Los Angeles Police Department concluded that 89-year-old Warren Gates was at fault, prosecutors have determined theres nothing to be filed against Collins, a spokesman for the L.A. City Attorneys Office said.
However, Collins may still face a civil lawsuit for the accident.
Gates died Friday from undisclosed injuries sustained in the crash, which authorities say occurred when the elderly man failed to yield to oncoming traffic and ran into Collins Ford Explorer, causing the former Hour Magazine host to lose control of the SUV and veer into two parked cars.
Collins then failed field sobriety tests administered at the scene and was taken into custody, where he was booked on suspicion of driving under the influence and released after posting $40,000 bail.
The Circus of the Stars ringmaster was ordered to serve four days behind bars, at an L.A. County facility of his choice, and given four years probation after pleading no contest Thursday to misdemeanor DUI and driving with a blood-alcohol level above 0.08 percent.
Collins, who checked into a 60-day treatment facility two days after his arrest, was also sentenced to 100 hours of community service; ordered to attend 26 Alcoholics Anonymous meetings (at least two per week); complete an 18-month alcohol-education program; and fined $500. He was also ordered to pay for the damage caused to the parked cars he hit.
He must surrender to authorities by Jan. 10 to start serving his time.
